Abstract

This article examines the legal protection of children in the context of Islamic family law in Indonesia. The protection of children is a fundamental aspect of Islamic family law, ensuring their well-being and rights in various family-related matters, including marriage, divorce, inheritance, and custody. The study employs a qualitative approach, utilizing a literature review and library research to explore the theoretical and practical dimensions of child protection within the framework of Islamic family law. The research highlights how Islamic family law in Indonesia has evolved to address contemporary issues surrounding child protection, particularly in cases of divorce, child custody, and maintenance. This study also analyzes the role of Islamic law in balancing the rights of parents and children, ensuring that children's best interests are prioritized in legal decisions. The findings suggest that while Indonesia has made significant strides in child protection, challenges remain in the effective implementation of legal provisions, especially when it comes to the rights of children in divorced or polygamous families. Additionally, the study explores the role of Islamic courts and other legal institutions in safeguarding children's rights and ensuring that justice is served in family disputes. The article concludes by emphasizing the importance of further legal reforms and awareness to strengthen child protection mechanisms in the Islamic family law system in Indonesia.
